Terms of Use

1. Using VisualizerWave

By accessing VisualizerWave or purchasing a license, you agree to these terms. You must be legally able to enter into this agreement. If you use the product for an organization, you confirm that you are authorized to act for it.

2. The Product

VisualizerWave is a browser-based creative tool for producing music visualizers. Audio analysis, image handling, preview rendering, and video encoding are designed to run on your device. Browser capabilities, available memory, graphics hardware, and selected export settings affect performance and compatibility.

3. Accounts and Purchases

An account may be required to access the application. Account authentication is provided through Clerk. Purchases are processed through Gumroad under the price and product description displayed at checkout. You are responsible for keeping your account access secure and for providing accurate purchase information.

4. Lifetime License

A valid lifetime purchase grants you a personal, non-exclusive, non-transferable license to use the purchased version of VisualizerWave and updates we make available to lifetime customers. It is not a subscription and does not transfer ownership of the software, source code, brand, templates, or service infrastructure.

5. Your Music, Images, and Exports

You retain your rights in media you bring to VisualizerWave and videos you create with it. You confirm that you have the rights and permissions needed to use and publish that media. VisualizerWave does not claim ownership of your audio, artwork, logos, project files, or exported videos.

6. Acceptable Use

You may not misuse the service, interfere with its operation, bypass access controls, resell access credentials, reverse engineer the service where prohibited by law, or use it to violate intellectual-property, privacy, or other rights. You may use your exported videos commercially if you have the necessary rights to their source media.

7. Compatibility and Availability

We work to keep VisualizerWave available and compatible, but uninterrupted operation on every browser, device, codec, or GPU cannot be guaranteed. Feature checks and current recommendations are provided on our compatibility page. We may modify the product to improve security, reliability, compatibility, or creative functionality.

8. Refunds and Consumer Rights

Our voluntary refund terms are described in the Refund Policy. Nothing in these terms limits mandatory consumer rights, statutory remedies for non-conforming digital content, or rights that cannot lawfully be waived in your country.

9. Intellectual Property

VisualizerWave, its interface, code, branding, original templates, and documentation are owned by Unform Audio or its licensors. Feedback may be used to improve the product without transferring ownership of your underlying work.

10. Disclaimers

To the extent permitted by law, the product is provided without guarantees beyond those expressly stated. You are responsible for keeping copies of important source media and exported files. Browser-local drafts are a recovery aid, not a substitute for your own backups or portable project files.

11. Liability

To the extent permitted by law, Unform Audio is not liable for indirect or consequential losses, lost opportunities, or loss caused by unsupported devices, third-party services, user media, or failure to maintain backups. This limitation does not apply where liability cannot legally be limited.

12. Changes

We may update these terms when the product or legal requirements change. Material changes will be identified by a revised date or another reasonable notice.
